| Shrnutí: | Tématem práce jsou dvě ze základních zásad pracovního práva, a to zásada smluvní volnosti a zásada rovného zacházení. Práce analyzuje jejich vzájemný střet a ovlivňování, přičemž nastiňuje teoretické přístupy, které lze pro řešení jejich kolize použít, kterými jsou zejména ekvita, proporcionalita a flexikurita. Cílem práce je na základě exegeze aktuální pracovněprávní legislativy a analýzy dalších souvislostí identifikovat, analyzovat a následně shrnout ty instituty a situace pracovního práva, u nichž se obě zásady ocitají v rozporu, včetně analýzy možných řešení. V návaznosti na tuto analýzu se práce zabývá úvahami de lege ferenda. The theme of the thesis is two of the basic principles of labour law, namely the principle of freedom of contract and the principle of equal treatment. The thesis analyzes their mutual conflict and influence, while outlines the theoretical approaches for resolving their conflict, which are mainly equity, proportionality and flexicurity. The aim of the thesis is - based on the exegesis of the current labor legislation and other related issues analysis - to identify, analyze and finally summarize the situation and institutes of labour law, in which the two principles find themselves in conflict, including an analysis of possible solutions. Following this analysis the thesis deals with considerations de lege ferenda. |
