520 2 |a Dizertační práce se zaobírá kategorií rozumnosti v soukromém právu. Rozumnost se aktuálně rozvíjí v kontinentálním právním systému pod tlakem anglosaského právního systému. Zdálo by se, že postačuje uvést rešerši zahraničních právních zkušeností teorie i praxe. To by ale dle mého názoru byl omyl. Pojem, obsah a funkce kategorie rozumnosti je totiž dán mimo právo samotné. V práci se proto zaobírám mimoprávními podněty. Primárně řeším otázku kategorie rozumnosti z pohledu filozofie. Dále též zohledňuji některé otázky jazyka, sociologie a ekonomie. Proto navrhuji, aby pojem, obsah i funkce kategorie rozumnosti byla určena na základě mimoprávních východisek. Podle mého názoru rozumnost je zaměřena na oblast ontologie. Z tohoto pohledu je velmi nešťastné, aby rozumnost byla omezena na pouhou otázku vědomostní, znalostní, technicistickou (technokratickou). Rozumnost tedy není totožná s racionalitou. Rozumnost má i etický, anebo eticko-estetický obsah. Za výbornou předlohu považuji antickou filozofii (Platón, Aristoteles, Cicero).  |% cze 
520 2 9 |a This thesis deals with the category of reasonableness in private law. Reasonableness is currently developing in the continental legal system under pressure from the Anglo-Saxon legal system. It would seem that it is sufficient to make a research of foreign legal experience, theory and practice. In my opinion it would be a mistake. Concept, content and function of reasonableness is given outside the law itself. Therefore, I treat in this work with non-legal impulses (which are behind the law). I resolve primarly the issue of reasonableness in terms of philosophy. Further, they also take into account some of the issues of language, sociology and economics. Therefore, I propose that the concept, content and function category reasonableness was determined (based) on non-legal grounds. In my view, reasonableness is focused on the ontology. From this perspective, it is very unfortunate that reasonaleness was reduced to a mere question of knowledge, technocratic, rationality etc. Reasonableness is not identical with rationality. Reasonableness has ethical, or ethical-aesthetic content. I consider ancienit philospohy (Plato, Aristotle, Cicero) like an excellent model.  |9 eng
