Práce popisuje vývoj dohledu nad finančním trhem v České republice a zabývá se blíže procesem unifikace regulace finančního trhu do instituce jednoho regulátora - České národní banky („ČNB“). Rigorózní práce dále rozebírá aktuální otázky vývoje dohledu nad finančním trhem s přihlédnutím k požadavkům regulace zavedenými Evropskou unií a její legislativou. Finanční krize odhalila potřebu vyšší regulace finančního trhu a ve stejném čase došlo k odhalení selhání v této regulaci, zejména v oblasti investičního bankovnictví. Rigorózní práce se věnuje jednotlivým krokům, které vedly k reformě dohledu nad finančním trhem a výkonem tohoto dohledu. Práce popisuje jednotlivé změny, které byly implementovány do českého práva na základě směrnic vydaných EU. Cílem práce je ohodnotit aktuální aspekty a důsledky těchto změn reformy dohledu nad finančním trhem ve vztahu k fungování celého finančního systému a subjektů zde působících. Práce porovnává výhody a nevýhody všech změn českého právního řádu, které byly přijaty v návaznosti na tyto změny. |% cze | |

The work describes the development of the supervision of the financial market in the Czech Republic and concerns in detail with the process of unification of financial regulation into one supervising entity - the Czech National Bank (“ČNB”) The work describes current developments and trends in the area of the banking supervision in the Czech Republic with the view of requirements imposed by the European Union and its legislation. The financial crisis revealed the necessity of a higher regulation of the financial market and at the same time revealed deficiencies in this regulation, especially in the area of the investment banking. The thesis concerns with steps which led to a reform of the financial regulation and its supervision from the perspective of the Czech Republic and the European Union. The work describes in detail changes introduced by the EU directives which had to be implemented into the Czech law. The aim of the thesis is to evaluate actual impacts of the reform on the whole financial system and the entities operating there. The thesis will compare advantages and disadvantages of the amendments to Czech law done because of the implementation. |9 eng |
