Zatřetí, podmínky, za kterých může státní orgán iniciovat zahájení řízení o popření právního otcovství k dítěti. | 520 | 2 | 9 | |a The dissertation thesis “The Best Interest of the Child” surveys the principle of the best interests of the child on the background of three family law issues. The issues were chosen as typical representants of three different approaches to rules regulating child issues. Namely the child care, authority of state bodies to iniciate the procedure leading to disestabilishing of paternity, and determination of child support amount were chosen. According to the Czech law, the court has law based test at disposal to decide questions of children care in case of divorce or separation of parents, the decision has to be made in the interest of the child. On the contrary, when the state body considers iniciation of procedure leading to disestabilishment of paternity, it is binded only by the general rule of the best interests of the child. Finally, Czech law offers set of criteria for determination of child support, but the best interests of the child are not explicitly among them. The legal regulation of such questions and historical development were analyzed and compared with foreign laws. |9 eng |
