Tato práce si klade za cíl jednak postihnout vývoj ochrany spotřebitele v evropském právu, jednak vymezit aktuální pojetí spotřebitelské politiky a ochrany spotřebitele evropským právem. V rámci takto vymezeného cíle práce je zkoumána pravomoc Společenství (nyní Unie) v oblasti ochrany spotřebitele a vazba spotřebitelské politiky na vytváření a rozvíjení vnitřního trhu, přičemž práce pracuje s hypotézou, že spotřebitelská politika EU nemá povahu samostatné politiky a její další rozvoj je úzce provázaný s vnitřním trhem. Druhý velký okruh otázek, jež práce řeší, se týká harmonizace předpisů členských států na ochranu spotřebitele. V tomto ohledu je největší pozornost věnována důsledkům tzv. minimální harmonizace a možnému přechodu k úplné (maximální) harmonizaci spotřebitelského acquis. Práce v této části zkoumá hypotézu, že v současném evropském právu pro posun k maximální harmonizaci neexistuje dostatečný právní základ. V závěru je provedeno zhodnocení dosažených poznatků a částečné potvrzení stanovených hypotéz.  |% cze 
520 2 9 |a Although consumer protection at EU level emerged as a by-product of economic integration of Europe, it has developed into a full-value EU policy. The aim of this thesis is to depict development of consumer protection in European law and at the same time to determine current conception of consumer policy and protection in European law. Within this aim, powers of the European Community (now European Union) in the field of consumer protection and the relation of consumer policy to the establishment and development of the internal market are examined, whereas the hypothesis, that EU consumer policy is not an independent policy and its further development is closely linked to the internal market, is tested. Another range of issues dealt with by the thesis concerns harmonisation of member states’ legal regulations on consumer protection. In this respect, we focus mainly on the consequences of so-called minimum harmonisation and on the prospective shift towards full (maximum) harmonisation of consumer acquis. In this part of the thesis, the hypothesis, under which current European law provides insufficient legal grounds for the shift towards maximum harmonisation, is tested. The conclusion of the thesis sums up presented argumentation and partially verifies stipulated hypotheses.  |9 eng
