| Shrnutí: | Tato disertační práce se zabývá texty soudních rozhodnutí jako autoportréty soudnictví, které lze díky jejich psanému charakteru zachytit, popsat a analyzovat. Na jedné straně tyto autoportréty staticky reflektují povahu právního systému a roli soudnictví uvnitř něj, na straně druhé jsou prostředkem dynamické právní změny. Tato změna se týká nejen významu ustanovení právních předpisů v procesu interpretace a aplikace práva soudy, ale i samotné role soudnictví a soudních rozhodnutí jako výstupů jeho činnosti především. Tato práce ukazuje, jakým způsobem texty soudních rozhodnutí reflektují vztah soudnictví ke státní moci, ke společnosti i k soudnictví samému. Tato práce se také zabývá konceptem legitimity soudnictví. Texty soudních rozhodnutí a jejich charakteristiky ovlivňujjí tuto legitimitu na výstupu. This thesis focuses on the texts of Czech judicial decisions. In its view, the texts may be understood as judicial self-portraits, which may be - given their written nature - subjected to analysis. On the one hand, these self-portraits reflect the nature of the legal system and the role of the judiciary within this system, on the other hand, they themselves represent a means of dynamic change of the system. This change is not only related to the understanding of laws within the process of interpretation and application of law, but also the role of the judiciary - and its decisions as the outputs of its activity. This thesis shows, in what ways do the texts of judicial decisions reflect the relationship between the judiciary and the state authority, judiciary and society as well as the judiciary's relationship to the judiciary itself. Furthermore, it focuses on the notion of judicial legitimacy. The texts and their qualities represent the factors that influence and condition the output legitimacy. |
