Práce se zabývá postavením obce při nakládání s odpady. Po vymezení předmětu a cílů práce jsou v krátkosti uvedeny a charakterizovány prameny právní úpravy. | 520 | 2 | |a Práce se zabývá postavením obce při nakládání s odpady. Po vymezení předmětu a cílů práce jsou v krátkosti uvedeny a charakterizovány prameny právní úpravy. V těchto kapitolách jsou též obsaženy hypotézy (otázky), na které se práce snažila nalézt odpověď. Následně je věnována důkladná pozornost definici odpadu. Dále je popsána povaha obce a její vztah k dalším subjektům (především svým obyvatelům a státu). Významnou část této kapitoly tvoří nástin prostředků, které obce mohou využít k prosazení odpadové politiky na svém území. V souladu s jejich rozdělením v právu životního prostředí je vlastní rozbor těchto prostředků, který tvoří stěžejní část práce, rozdělen do dvou kapitol, které se zabývají nástroji přímé a nepřímé regulace. Na základě rozboru jednotlivých nástrojů jsou poté identifikovány úlohy, které obce plní při nakládání s odpady. Práce také srovnává českou právní úpravu postavení obcí při nakládání s odpadem s právní úpravou v Anglii a na Slovensku. Práce vychází ze stavu právních předpisů ke dni 27. 6. 2013. |% cze | |

Following the definition of its subject-matter, the thesis briefly describes and discusses the relevant legislation. The thesis then thoroughly examines the definition of waste. The next section describes the nature of the municipality and its relationship to other stakeholders (notably its population and the state). An important section of this section is the outline of the means available to the municipality for enforcing a waste policy in its territory. The actual analysis of these means, which follows their classification in environment law, forms the basis of the thesis. It is divided in two parts discussing the direct regulatory instruments and indirect regulatory instruments. Drawing on the analysis of the individual instruments, the thesis then identifies the responsibilities of municipalities with respect to waste management. The thesis then compares the position of municipalities with respect to waste management in the Czech legislation with the positions set out in English and Slovak laws.
