První část se zabývá detailním rozborem jednotlivých institutů s asperačním prvkem, v rámci části druhé se autor snaží poukázat na vybranou problematiku spojenou s praktickou aplikací jednotlivých institutů s asperačním prvkem, část třetí potom představuje asperační a jiné zvláštní způsoby trestání vybraných forem trestné činnosti v historických a geografických souvislostech. |% cze | |
| 520 | 2 | 9 | |a New Czech Penal Code allows the juridical aggravation of the penalty of imprisonment in certain circumstances. These circumstances are in a form of specific juridical institutes defined by law; the Czech Penal Code allows the aggravation in the case of sentencing for the multiple real concurrence of the crimes, especially serious recidivism and in the case of sentencing for the intentional crime committed in favour of the organized criminal group. The presented thesis analyses abovementioned juridical institutes with the element of aggravation. Relevant text is basically structured into three main parts. The first part is focused on the detailed analysis of the relevant juridical institutes with the element of aggravation, the subject matter of the second part are the chosen problems related with the application of the aggravation, the third part contains historical and geographical aspects related to the core topic of the thesis.
