Svým pojetím je tato práce snahou o kritickou analýzu stávající právní úpravy. The topic of this thesis is enforceable notarial record as a formalized procedural consent to an enforcement. It is a unique legal institute, which offers a very effective solution to legal subjects concerning both possible future and existing problems resulting from various relationships between obligee and obligor. By drawing up a notarial record with consent to enforcement the obligee gains a power for execution and so he need not pass a preceding court procedure which often lasts many years. Thus, in case that the obligor does not fulfil his obligation of his own will, the obligee may propose an execution without any other necessary step. In accordance with the requirements concerning this type of thesis, I tried to use as much specialized legal literature sources as possible - legal texts from monographies, journals, including internet sources, as well as legal regulations, and especially judicature.
